Terms and Conditions

1. Quotations and Deposits

Before work begins, Build91 will provide a written quotation via email or WhatsApp based on the Client’s provided information. A 50% deposit is required to initiate work unless otherwise agreed upon in writing. This deposit is non-refundable if the Client cancels the project.

2. Use of Services

Build91’s visuals are intended solely as artistic impressions and illustrative representations of the final product. The completed construction or design may differ significantly from the rendered visuals and depends on the team executing the project.

3. Ownership and Usage Rights

  • Build91 retains the right to use any visuals it creates for marketing, portfolio, or promotional purposes, including publishing on its website and social media; unless otherwise agreed to with the client on a case to case basis.

  • All original designs and specifications provided by the Client remain the intellectual property of the Client.

4. Quotation Validity and Changes

  • Quotes remain valid for the duration stated within the quotation. If no duration is specified, validity defaults to 28 days from the date of issue.

  • Cost estimates are subject to change based on evolving project scope or requirements. Build91 will notify the Client of any price changes for approval before proceeding.

  • Quotes are based on an estimated number of working hours and scope of work. Additional requests or scope changes that increase required time may incur additional charges and may affect the project timeline.

5. Project Timelines and Client Feedback

  • Project timelines depend on timely and accurate Client feedback.

  • While Build91 will strive to deliver work on schedule, deadlines are not guaranteed and may be extended at Build91’s sole discretion, based on workload or unforeseen delays.

6. Payment Terms

  • Invoices must be paid within 7 days of issue.

  • Late payments or Defaults may lead to termination of work contract, and any ownership and usage rights for the client.

  • Build91 reserves the right to pause work or withhold final deliverables until all dues are settled in full.

7. Third-Party Indemnity

The Client agrees to indemnify and hold harmless Build91 against any third-party claims related to:

  • Services provided by Build91, and

  • Any materials or content supplied by the Client.

8. Use of Consultants

Build91 may engage independent consultants to complete portions of the work. The Client agrees not to hold Build91 liable for any damages or losses resulting from the acts or omissions of these consultants, including breaches of intellectual property laws. While reasonable measures will be taken to safeguard the Client’s data, Build91 is not liable for any unauthorized access, misuse, or data breaches by third parties.

9. Disclaimer and Limitation of Liability

  • All visuals are provided “as-is”, without any express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement.

  • Build91 shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, business interruption, or data loss, arising from the use of its services or visuals.

10. Colour Accuracy Disclaimer

Due to variations in screen displays, printers, and digital processing, Build91 cannot guarantee exact colour matches between rendered visuals and physical materials.

11. Severability and Entire Agreement

If any clause in these Terms is found to be unenforceable, the remaining clauses will remain in effect. These Terms represent the entire agreement between Build91 and the Client and supersede all prior communications or agreements. Any changes or a new agreement must be made in writing and signed by both parties.

12. Independent Contractor Relationship

Each party operates as an independent contractor. These Terms do not establish any partnership, joint venture, or agency relationship between the parties.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Raipur, India.
